Terms of Use
The terms for using this website. Work we do for clients is covered by a separate written agreement.
1. About these terms
This website is run by Asterisk (“Asterisk”, “we”, “us”), a creative technology and software company based in Nairobi, Kenya. By using the site you agree to these terms. If you don’t agree, please don’t use it.
These terms cover your use of this website only. Work we do for clients is covered by a separate written agreement.
2. Using the site
You may use this website for lawful purposes. You agree not to:
- try to break, overload, probe or gain unauthorised access to the site, its hosting or anything connected to them;
- use automated tools to copy the site or to send it a volume of requests that affects other visitors (search engines and AI assistants that follow our robots.txt are welcome);
- introduce malware, or anything else harmful or unlawful;
- pretend to be us, or to be connected to us, when you are not; or
- use the site in a way that breaks the law, including Kenya’s Computer Misuse and Cybercrimes Act, 2018.
3. What the site is
We publish this site to describe our company, our services and how we work. We try to keep it accurate and up to date, but we give no promise that it is complete, current or free of errors, and it can change or go offline at any time without notice.
Nothing on the site is an offer, a quotation or a contract, and nothing on it is professional, legal, financial or technical advice for your situation.
4. Examples, concepts and demonstrations
Parts of this site are illustrations, and you should read them as that:
- Projects under Work that are marked as concepts are not client projects, and they use invented names, data, prices and conversations. Any resemblance to a real person or business is a coincidence. Projects marked as client projects are real work for the named client; where they show sample data, it is the client’s own fictional demo data.
- The interactive examples (the plot finder, the agent conversation, the web-or-mobile chooser and the project timeline) show how something could work. They are not working products, and they give no advice and make no commitment.
- The project timeline, and anything else described as “typical”, shows how a project often runs. It is not a promise of a schedule, a price or a result.
- How we describe our use of AI is a description of our approach, not a guarantee about any particular piece of work.
5. Intellectual property
The text, design, illustrations, code and layout of this site, and the Asterisk name and mark, belong to us or our licensors and are protected by copyright and other law. You are welcome to view the site, to link to it and to share pages with a link back to us.
You may not copy, reproduce, modify, sell or reuse the site’s content for commercial purposes without our written permission. If you think something on the site infringes your rights, tell us at the address below and we will look into it promptly.
6. Other people’s names and trademarks
This site names products and services that belong to other companies, such as M-Pesa, WhatsApp, Instagram, Cal.com, ChatGPT, Claude, Perplexity and Google. Those names, logos and marks belong to their owners. We use them to say what we connect to or how a link works, not to suggest that the owners are connected with us, or that they approve or endorse us or our work.
7. Links to other services
The site links to services we don’t control, such as Cal.com, WhatsApp and AI assistants. Their own terms and privacy policies apply when you use them. We are not responsible for their content, availability or practices, and a link is not an endorsement.
8. Getting in touch
You can contact us by email, WhatsApp or Cal.com. Please don’t send sensitive personal information, passwords or confidential material in a first message; we will agree with you how to share it safely. We use what you send us as described in our Privacy Policy.
9. Projects and proposals
Briefs, calls, messages and proposals don’t create an agreement between us until both sides have signed a written agreement. Any project we take on is governed by that agreement, which takes precedence over anything on this website.
10. No warranties
To the fullest extent the law allows, this website and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We don’t promise that the site will be uninterrupted, secure or free of errors or harmful components.
11. Our liability
To the fullest extent the law allows, Asterisk, its owners, staff and contractors are not liable for any loss or damage, including indirect or consequential loss, loss of profit, loss of data or loss of opportunity, arising from your use of this website or from relying on anything on it.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.
12. Changes and access
We may change these terms, and the site, at any time. The new version applies from the date shown on this page, and using the site afterwards means you accept it. We may also suspend or end access to the site for anyone who breaks these terms.
13. Governing law
These terms are governed by the laws of Kenya. We will always try to settle any dispute about them with you in good faith first; if that fails, the courts of Kenya have jurisdiction.
14. General
If any part of these terms is found to be unenforceable, the rest still applies. If we don’t enforce a term straight away, that doesn’t mean we have given it up. These terms, with our Privacy Policy and Cookie Policy, are the whole agreement between us about your use of the site.
15. Contact
Questions about these terms, or a concern about something on the site: hello@asterisk.co.ke.
